A three-judge panel on the 9th Circuit Court of Appeals upheld Newsom's March lockdown order, basically saying they couldn't trust Christians to follow the rules and gather without getting someone sick, therefore allowing them to open would be tantamount to allowing churches to enter into a "suicide pact."

We're dealing here with a highly contagious and often fatal disease for which there presently is no known cure. In the words of Justice Robert Jackson, if a "[c]ourt does not temper its doctrinaire logic with a little practical wisdom, it will convert the constitutional Bill of Rights into a suicide pact."

Where state action does not "infringe upon or restrict practices because of their religious motivation" and does not "in a selective manner impose burdens only on conduct motivated by religious belief," it does not violate the First Amendment. [...]

As a threshold matter, the State contends that, in light of the ongoing pandemic, the constitutional standards that would normally govern our review of a Free Exercise claim should not be applied. "Although the Constitution is not suspended during a state of emergency," the State tells us, "constitutional rights may be reasonably restricted 'as the safety of the general public may demand'"


Full article here.  I have not independently fact checked the report. However, it sounds like something the 9th Circuit would do.

Trump has already declared that churches should open and openly said he will be on the side of the churches if they restrict attendance.

        What's next? where what and when we can drive-eat-live? What else-what and how we dress? Last time that happened for me I was in The U S Navy. Course The Navy had no problem with me motocrossing. Yet bars and pot shops and gittin yer hair done be okey dokey.  :-X Maybe time to disband the 9th circuit? Can that be done? RIDE SAFE.

I doubt it.

But, if we give Trump 4 more years and Mike Pence 8 years, maybe enough of the judges will have been replaced to change it for the better.

Update:

California Church Banned from Holding Services Appeals to US Supreme Court

From the article:

California is one of the last states to continue banning in-person religious services and now one church has taken that prohibition all the way to the US Supreme Court.

The South Bay Pentecostal Church in Chula Vista has asked the high court to issue an emergency injunction against California's governor.  

The church's attorneys said in a statement this weekend they want the justices to command Gov. Gavin Newsom "to cease and desist his biased shutdown of religious worship in California, in blatant violation of the First Amendment's constitutional guarantee that citizens may freely exercise their religious faith."
