Some may remember this. A yr ago a Kroger in Indy was robbed and a employee shot the guy. The the chic that was held at gun point is sueing Kroger and the guy that saved her.  :uglystupid2:

Under both Fed and some State laws, under specific circumstances in civil cases, there are rules requiring a losing party pay the prevailing party's litigation expenses.  Like when a case is shown to have been brought in bad faith (plaintiff), or when a party unreasonably refuses to settle (plaintiff) (offer of 20K$ is refused, then a long expensive trial results in a 20K$ jury verdict), or when the suit is brought (and won) regarding loss/enforcement of civil rights (defendant) (City of Chicago ordered to pay all of the costs of NRA lawsuits challenging handgun ban McDonald..... then the City then appealed that decision, then had to pay all litigation cost of the costs litigation as well).  Around 1.5 million bucks, which is sweet indeed (except for the taxpayers who get the ultimate bill).

But it is limited in application.  If your case is at least arguable, no costs can be charged.

And litigation costs includes attorneys fees, experts fees, forensics, laboratories, notices, research, discovery, travel, room and board, yada (tens of thousands).

Court costs are only the statutory fees to file a case and motions, and is relatively cheap (hundreds).

Most civil litigation like this is brought on a contingent fee basis, so the Plaintiff's attorney, who generally advances all litigation and court costs, gets nothing if he loses (and this helps cut down on the BS).  But they still do it, explaining to the client it is not a strong case, so they'll settle for nuisance value.  So if it costs the ins co a minimum of 10K$ to defend a case (ins co's mostly farm out the trial defense work to other private firms), the ins co will very often offer 5-10K$ to settle, and over the long run it is a good business decision for the company, thou it causes nuisance suits to flourish.

I agree. I could tell stories, but I'll keep it short.  The latest:
After my wifes accident we went to an attorney who took our information and about two weeks later called us to come to his office.
We were presented with a check for $19,500 which was all the girl (who collided with my wife) had for insurance coverage. It was $20K but $500 went for a settlement to the hospital on a $65K emergency room bill.

The attorney did not take a dime!  He said it was no big deal, that he just made a couple of phone calls.

Most people talk bad about lawyers, untill they need one. Then their the  best people on the planet!!

Huh.. Her son comits a crime and is killed as a result and SHE is suing. Give me a freeking break. When some lowlife piece if scum walks into a buisness and tried to rob it he gives up his right to be safe......

Sorry. I have to agree with low-life's mother. This place was posted as a designated victim zone. He had every reasonable expectation that he could walk inside and commit any atrocity he wanted, because nobody inside would be able to defend themselves. That's misrepresentation.
